Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Dimly macOS application and the Dimly website (dimly.io), operated by Louis, an independent developer based in France.

By downloading, installing, or using Dimly, you agree to be bound by these Terms. If you do not agree, do not use Dimly.

2. Free Trial

Dimly offers a 7-day free trial with full access to all features. No credit card or payment information is required to start the trial.

At the end of the trial period, you may choose to purchase a license to continue using Dimly. There is no obligation to purchase, and the trial will simply expire without any charge.

3. License Grant

Upon purchase, Dimly grants you a non-exclusive, non-transferable, perpetual license to use the Dimly application for personal or business purposes, subject to the following conditions:

  • Each license key may be activated on up to 2 macOS devices
  • The license is for a single user only and may not be shared or resold
  • The license includes all future updates to Dimly at no additional cost

You do not acquire ownership of Dimly. You receive only a limited right to use the software under these Terms.

4. Purchases & Payments

All purchases are processed through Paddle, which acts as our Merchant of Record. This means Paddle is the legal seller of Dimly and handles all payment processing, invoicing, tax collection (including VAT), and billing.

By completing a purchase, you also agree to Paddle's Checkout Buyer Terms.

Prices are displayed at checkout and may vary by region. Paddle determines the final price including applicable taxes.

5. Refund Policy

Dimly is a digital product delivered immediately upon purchase. In accordance with Article L221-28, 13° of the French Consumer Code and EU Directive 2011/83/EU, you acknowledge and agree that:

  • Your license key is delivered immediately after payment
  • By completing the purchase, you expressly consent to the immediate delivery of the digital content
  • You acknowledge that this immediate delivery waives your right of withdrawal (14-day cooling-off period)

A 7-day free trial is available so you can evaluate Dimly before purchasing. We encourage you to use the trial to ensure Dimly meets your needs.

If you experience a technical issue that prevents Dimly from functioning, contact us at support@dimly.io and we will work to resolve it. For payment disputes, contact Paddle support as they are the Merchant of Record.

6. Device Activation

To use Dimly after purchasing a license, you must activate it on your device. Activation requires an internet connection and involves the following:

  • Your device sends a unique hardware identifier (fingerprint) to our servers
  • The server verifies your license key and registers the device
  • Each license supports a maximum of 2 activated devices

To deactivate a device (for example, when switching to a new Mac), contact us at support@dimly.io. We will remove the old device so you can activate a new one.

7. Intellectual Property

Dimly, including its source code, design, name, logo, and documentation, is the exclusive property of its developer. All rights not expressly granted in these Terms are reserved.

You may not:

  • Copy, modify, or distribute Dimly or any part of it
  • Reverse engineer, decompile, or disassemble the software
  • Remove or alter any proprietary notices or labels
  • Sublicense, sell, or redistribute your license key
  • Circumvent or attempt to bypass activation or device limits

8. Termination

We may terminate or suspend your license immediately, without prior notice, if you:

  • Violate any of these Terms
  • Attempt to circumvent license activation or device limits
  • Use Dimly in a way that infringes on intellectual property rights
  • Engage in fraudulent activity related to your license or payment

Upon termination, your license key will be revoked and all device activations will be deactivated. You must cease all use of Dimly immediately.

9. Limitation of Liability

Dimly is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law:

  • We do not guarantee that Dimly will be error-free or uninterrupted
  • We are not liable for any indirect, incidental, consequential, or special damages
  • Our total liability is limited to the amount you paid for your Dimly license

Nothing in these Terms excludes or limits liability that cannot be lawfully excluded under French or EU law, including liability for fraud or gross negligence.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent French courts.

If you are a consumer in the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of Dimly after changes constitutes acceptance of the revised Terms.
